These Terms of Service ("Terms") govern your access to and use of ExamCrutch ("we", "us", or "our"), including our website, applications, and related services (collectively, the "Service"). By creating an account, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
ExamCrutch provides tools to practise past exam papers and related educational content online. Features may include question navigation, answer submission, progress tracking, and automated or AI-assisted feedback and marking. We may add, change, or remove features at any time.
2. Eligibility and accounts
You must provide accurate registration information and keep your account credentials confidential. You are responsible for activity under your account. Notify us promptly if you suspect unauthorised access. We may suspend or terminate accounts that violate these Terms or pose a risk to the Service or other users.
3. Acceptable use
You agree not to:
- Use the Service in any way that violates applicable law or infringes others' rights.
- Attempt to probe, scan, or test the vulnerability of the Service, or bypass security or access controls.
- Copy, scrape, resell, or redistribute our content or outputs at scale without permission, except as allowed for your personal study.
- Upload malware, harass others, or overload our infrastructure.
4. Content and intellectual property
Exam materials, branding, software, and other materials made available through the Service are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for your personal, non-commercial learning, subject to these Terms. Past-paper content may include third-party materials; your use remains subject to any applicable notices or restrictions we display.
5. AI-assisted marking and feedback
Where the Service uses automated or AI-assisted systems to generate feedback or scores, such outputs are provided for learning support only. They may be incomplete or incorrect and are not a substitute for official marking, professional advice, or your own judgment. You should verify important outcomes with your school, exam board, or other authoritative sources.
6. Subscriptions and payments
Paid plans, billing cycles, taxes, and cancellation are described at checkout and in your account or subscription settings. Unless otherwise stated, fees are non-refundable except where required by law. We use third-party payment processors; their terms also apply to payment transactions.
7. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or any particular exam result or outcome.
8. Limitation of liability
To the fullest extent permitted by law, we (and our affiliates, directors, and suppliers) are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Our total liability for claims arising from the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim, or (b) zero if you have not paid fees. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.
9. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, if we are required to by law, or if we discontinue the Service (with reasonable notice where practicable). Provisions that by their nature should survive will survive termination.
